The following policies apply to all estimates, invoices, service agreements, and projects performed by Apex Maintenance unless otherwise agreed to in writing.

These policies establish the standards, expectations, and responsibilities that govern all work performed by Apex Maintenance. They are designed to protect both our customers and our business by ensuring clear communication, professional service, and fair practices.
A deposit is required before work begins for any of the following:
Projects with a total value exceeding $250.00
Projects requiring materials to be purchased before work begins
Projects anticipated to take more than one business day to complete
Our standard deposit is 50% of the estimated project total. The deposit is applied toward the final balance. If the customer cancels after materials have been purchased, work has been scheduled, or other costs have been incurred, Apex Maintenance may retain all or part of the deposit to cover actual costs incurred, including purchased materials, scheduling, administrative expenses, and lost labor time.
Final billing will be adjusted by subtracting the deposit received.
Cancellations made more than seven (7) full business days before the scheduled start time may be eligible for a refund of the deposit, less any actual costs incurred.
Cancellations made less than seven (7) full business days before the scheduled start time will forfeit the full deposit.
One reschedule allowed per project provided at least 72 hours’ notice is given.
Project will be resumed on the rescheduled date.
Cancellations within forty-eight (48) hours of the scheduled start time, or no-shows, will forfeit the full deposit and may be assessed a $25.00 rescheduling fee.
Exceptions may be made for verified emergencies at the sole discretion of Apex Maintenance.
Unused deposit credits are valid for 12 months from the date of cancellation or last project date, whichever is later.
Apex Maintenance provides a one (1) year workmanship warranty on labor performed. This warranty covers defects resulting directly from the quality of installation or repairs performed by Apex Maintenance.
Exclusions include:
Damage resulting from misuse, accidents, or lack of maintenance
Ceiling fan installation requiring adjustment because of installation
Cabinets, trim, doors, fixtures, or similar items installed incorrectly due to workmanship
If a covered workmanship issue occurs during the warranty period, Apex Maintenance will repair the issue at no additional labor charge.
The workmanship warranty does not cover:
Client-supplied materials or equipment
Damage caused by children, pets, tenants, or other contractors
Normal wear and tear
Weather-related or environmental damage
Improper use or lack of maintenance
Acts of nature, pests, or other Acts of God
Modifications made by unauthorized persons
Any warranty exclusions by the manufacturers of material or equipment
Work performed outside the original scope of work
Customers may elect to provide their own materials. Fixtures, appliances, paint, flooring, lumber, or other supplies.
Payment is due immediately upon completion of the project unless otherwise agreed in writing.
Accepted payment methods:
Cash
Check
Zelle (payment methods may be accepted at the discretion of Apex Maintenance)
Returned checks and unpaid balances may be subject to applicable fees and collection costs permitted by law.
Unless specifically stated in the written Scope of Work, Apex Maintenance includes:
Labor to complete the agreed-upon work
Basic tools and equipment
Standard installation materials unless otherwise specified in writing
Any additional work not listed in the scope is considered beyond our original task and may be subject to additional charges.
Unless specifically stated in the Scope of Work, the following services are excluded:
Moving furniture or personal belongings
Deep cleaning or post-construction cleaning
Hauling debris or junk removal
Landscaping, grading, or exterior site work
Permits or inspections (unless otherwise agreed)
Work outside of the agreed project scope
These services may be added for an additional fee if requested.
Any work requested outside the original estimate requires customer approval before work begins.
Additional work may result in:
Additional labor charges
Material costs
Revised schedule adjustments
Possible effects on the performance of related customer authorizations
Customers are responsible for providing safe and timely access to the work area. This includes:
Being present at the scheduled arrival time
Ensuring pets, children, vehicles, tools, and work areas are clear
Providing keys, lock codes, or other agreed-upon entry methods
Delays caused by inaccessible work areas may result in additional labor charges.
Many repairs involve conditions that cannot reasonably be discovered until work has begun.
Plumbing leaks
Mold or mildew
Electrical damage
Pest damage
Improper work completed by previous contractors
Structural or material defects
Hazardous materials
If hidden conditions are discovered:
Work may be paused
The customer will be notified immediately
Additional costs may apply for time and materials
Apex Maintenance is not responsible for conditions that were not visible or reasonably discoverable at the time of estimate
Apex Maintenance reserves the right to refuse or discontinue work if:
Working conditions become unsafe
Payment obligations are not met within the agreed time
The project scope is significantly altered without authorization
The customer engages in abusive, threatening, or disrespectful behavior
The customer requests work outside the approved Scope of Work without authorization
If work is discontinued under these circumstances, the customer remains responsible for payment for all completed work, purchased materials, and any applicable rescheduling or cancellation fees.
Customer grants Apex Maintenance permission to take photos and/or videos of the project before, during, and after completion for the purpose of:
Documenting the work performed
Quality assurance
Marketing and promotional use (including social media, website, and print materials)
No identifying information about the customer will be used without written consent.
Apex Maintenance is not responsible for delays caused by weather or other conditions beyond our control. Inclement weather, unsafe conditions, or seasonal limitations may affect the project schedule.
We will communicate promptly and work with the customer to reschedule as soon as conditions allow.
Material lead times and availability are outside of our control. Delays caused by manufacturers, suppliers, or shipping issues may affect project timelines.
Apex Maintenance will make every effort to source materials in a timely manner and will notify the customer of any delays that arise.
Apex Maintenance holds Michigan Occupational Code license #INSERT LICENSE NUMBER. This number will be included on all estimates, invoices, and contracts as required by Michigan law.
If this agreement is signed at a location other than Apex Maintenance’s place of business, the customer has the right to cancel this transaction without penalty within three (3) business days from the date of signing, as required by Michigan’s Home Solicitation Sales Act and the FTC Cooling-Off Rule.
To cancel, the customer must provide written notice to Apex Maintenance at the address or email listed below before midnight of the third business day.
This agreement and these policies are governed by the laws of the State of Michigan without regard to conflict-of-law principles.
Any dispute arising out of or relating to this agreement shall be resolved exclusively in the state or federal courts located in Washtenaw County, Michigan. By signing below, the customer agrees to the jurisdiction of these courts.
Either party may also choose binding arbitration in Washtenaw County, Michigan, in accordance with the rules of the American Arbitration Association.
To the maximum extent permitted by law, Apex Maintenance’s total liability for any claim arising from or related to the work shall not exceed the total amount paid by the customer for the specific project giving rise to the claim.
Apex Maintenance is not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, loss of income, or property damage.
